Shia women can not inherit land or property


Regarding Women and inheritance of Land in Shiism. Let’s Quote the Sahih hadiths from their most authentic book al Kafi.

The Author of al Kafi sheikh al kulayni made an entire chapter in Volume Seven called:

“باب أَنَّ النِّسَاءَ لَا يَرِثْنَ مِنَ الْعَقَارِ شَيْئاً”
“Chapter: That Women inherit nothing from real-estate/Land” 

(مجلسي حسن23/189 – بهبودي صحيح3/285)
عَلِيٌّ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ جَمِيلٍ عَنْ زُرَارَةَ وَ مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَبِي جَعْفَرٍ ( عليه السلام ) قَالَ لَا تَرِثُ النِّسَاءُ مِنْ عَقَارِ الْأَرْضِ شَيْئاً .

Ali from his Father from Ibn Abu Umayr from Jameel from Zurarah and Muhammad bin Muslim from the Imam Abu Ja’afar PBUH that he said: “Women do not inherit anything of land or fixed property.”

Allamah al Bahbudi placed it in His SAHIH AL KAFI 3/285 and said SAHIH.
Allamah al Majlisi said the chain of narrators is Good in Mira’at al Uqool 23/189.

حُمَيْدُ بْنُ زِيَادٍ عَنِ الْحَسَنِ بْنِ مُحَمَّدِ بْنِ سَمَاعَةَ عَنْ عَمِّهِ جَعْفَرِ بْنِ سَمَاعَةَ عَنْ مُثَنًّى عَنْ عَبْدِ الْمَلِكِ بْنِ أَعْيَنَ عَنْ أَحَدِهِمَا ( عليهما السلام ) قَالَ لَيْسَ لِلنِّسَاءِ مِنَ الدُّورِ وَ الْعَقَارِ شَيْ‏ءٌ .

Humaid bin Ziad from al Hassan bin Muhammad bin Sama’ah from his uncle Ja’afar bin Sama’ah from al Muthna from Abdul Malik bin A’ayyun from one of the Two Imams may Allah be pleased with them: “Women will have nothing of houses or land.”

Al Allamah al Bahbudi says SAHIH and places it in his book SAHIH AL KAFI 3/285.

عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ وَ مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ وَ حُمَيْدُ بْنُ زِيَادٍ عَنِ ابْنِ سَمَاعَةَ جَمِيعاً عَنِ ابْنِ مَحْبُوبٍ عَنْ عَلِيِّ بْنِ رِئَابٍ عَنْ زُرَارَةَ عَنْ أَبِي جَعْفَرٍ ( عليه السلام ) أَنَّ الْمَرْأَةَ لَا تَرِثُ مِمَّا تَرَكَ زَوْجُهَا مِنَ الْقُرَى وَ الدُّورِ وَ السِّلَاحِ وَ الدَّوَابِّ شَيْئاً وَ تَرِثُ مِنَ الْمَالِ وَ الْفُرُشِ وَ الثِّيَابِ وَ مَتَاعِ الْبَيْتِ مِمَّا تَرَكَ وَ يُقَوَّمُ النِّقْضُ وَ الْأَبْوَابُ وَ الْجُذُوعُ وَ الْقَصَبُ فَتُعْطَى حَقَّهَا مِنْهُ .

Some of our associates from Sahl bin Ziad and Muhamad bin Yahya from Ahmad bin Muhammad and Humeid bin Ziad from Ibn Sama’ah all of them from ibn Mahboub from Ali bin Ri’ab from Zurarah from Imam Abu Ja’afar PBUH that the woman does not inherit from what her husband leaves her from towns and houses and weapons and animals, instead she inherits from money and furniture and clothes and She will get the value of the bricks, the doors, the wood and the bamboo.

Al Majlisi said: SAHIH 23/188.
Al Bahbudi said: SAHIH 3/284.

    Good presentation, but doesnt this section deal with the wife inheriting the husband in shia law, many modern court cases had the same problem just google it. Anyway a typcial shia response can be ” oh this is wives not daughters”.

    On a side note ive signed upti Islamic forum after 4 weeks ive had no confirmation email, and when i tried a lost password request link a few times no such email was ever recieved. My first and last post was on ” majlisee on zayd ibn ali”. I know you are part of that forum get the admin to wakeup and smell the cofee please.

THAT CRIMINAL AS WELL AS UNETHICAL ACT IN ITSELF TELLS HIS LINEAGE .     I JUST GIVE YOU A SIMPLE EXAMPLE . YOU ARE A FARMER . YOUR FATHER’S ENTIRE INCOME IS FROM THE BELONGINGS OF LAND . YOU HAVE SIX SISTERS , HAPPILY MARRIED AND TOOK AWAY THREE PORTIONS OF YOUR FATHER’S ENTIRE LAND LEAVING BEHIND 1/4TH AND YOU HAVE YOUR OWN SIX SONS . WHAT THEY WILL DO AND WHAT THEY WILL EAT FROM THIS 1/4TH HOLDINGS LEFT . COULD WITH THIS SIMPLE EXAMPLE SOME SENSE ENTERED IN YOUR OTHERWISE USELESS, NONFUNCTIONING SUNNI BRAIN . ?

    I really do wish you shia would read your own books then blow the trumpet. tohfatul awam is a Urdu book, for Pakistanis not the world shia audience. Moreover it is a book on prayers supplications and etiquettes of ziyarats. It is not solely dedicated to fiqh as you wish to portray. Secondly it is based upon rulings of sistani and Najaf housa the few rulings it does have so muqalids or Shias who follow another mujtahid can’t derive benefit of it anyway. Lastly the brother qouted you hadith from Shia books which is the usul of your fiqh so you will have to try a lot harder to wiggle out of it.

    I feel wacking your head like some nutter has effected your thinking power.

    A request to the brothers here, can you guys help me or direct me to a issue of Sunni Shia on that of prayer. The accusation of the Shia as in why we have confusion on how the prophet prayed and the differences of the sahabah in this regard. Please bear in mind i do taqleed and value rulings of all the four imams. It is just a question upon my mind lately.

    This “Zaheer Husain Khan” is letting his emotions get away with him.
    His ranting in caps with no paragraphs makes it hard to read anything he says. It is one big distracting, ugly eyesore.
    It was hard for me to get beyond the first words, “LIKE A FROG IN AN ABONDONED WELL” — this immediately reminded me of his Imaginary hidden Twelfth Imam Mickey Mouse hiding in the well of Jamkaran or the cellar of Samarra (or wherever these poor deluded Rafidis think he went).
    Zaheer, try to write in a less distracting way, if you want anyone to read your rants. Communication 101, bro: focus on that first, then we can talk about your religion.

    What is important to member is that Fadak was not in fact inheritance. It falls under the category of Fey, or a gift. It was a war possession given to the Prophet after Khyber, which he then gifted to Fatima. Since this was done within his lifetime, the whole inheritance argument is illegitimate to begin with
