Taqqiyah of the Shia among themselves


al-Salamu `Aleykum,

Yes you’ve guessed it, another topic about Taqqiyah, this time I’ll write about the Taqqiyah of the Shia with other Shia, their lord al-Khomeini who surpasses some of the Prophets of bani Israel according to some of their scholars said while defining Taqqiyah:

و منها التقسيم بحسب المتقى منه، فتارة تكون التقية من الكفار و غير المعتقدين بالإسلام سواء كانوا من قبيل السلاطين أو الرعية، و أخرى تكون من سلاطين العامة و أمرائهم «و ثالثة» من فقهائهم و قضاتهم، «و رابعة» من عوامهم «و خامسة» من سلاطين الشيعة أو عوامهم إلى غير ذلك

[Dividing Taqqiyah based on the ones it is used with, sometimes it(taqqiyah) is used with the Kouffar and those who do not believe in Islam whether they were Sultans or average people, and other times it is used with the Sultans of the `Ammah(Sunnies) or their Emirs, Thirdly: It can be used with their scholars and judges, Fourthly: It can be used with their average laypeople, and Fifthly: It can be used with the Sultans of the Shia and their laypeople among other uses]

From the examples of this matter is that the Shia jurists declared the Najasah or impurity of Ahlul-Kitab, and they issued verdicts forbidding the Shia from eating their food and drinking their drinks, even bread and water. However, many of the biggest contemporary scholars hold a different opinion and they are of the opinion of Tahara or purity of Ahlul-Kitab but since they practice Taqqiyah with their own followers they will not issue verdicts.

Shia scholar Mughniyyah says regarding this matter in his book “Tafsir al-Kashif” 3/18, in Surat al-Ma’edah verse #5:

كثير من المراجع الكبار على القول بطهارته، منهم السيد الحكيم والسيد الخوئي الذي اسر برأية لمن يثق به

[Many of the biggest Shia Maraji` are of the opinion of purity, from them is al-Sayyed al-Hakeem and al-Sayyed al-Khoei who told his opinion secretly to those he trusts.]

Mughniyyah says in “Fiqh al-Imam al-Sadiq” pg33 that he met three contemporary Shia scholars:

الشيخ محمد رضا آل يس في النجف، والسيد صدر الدين الصدر في قم، والسيد محسن الأمين في لبنان، وقد أفتوا جميعهم بطهارة الكتابي واسروا بذلك الى من يثقون به، ولم يعلنوا ذلك خوفا من المهوشين، وان الكثير من الفقهاء يقولون بالطهارة ولكنهم يخشون أهل الجهل والله أحق ان يخشوه

[Sheikh Muhammad Reda Aal Yasin in Najaf, al-Sayyed Sadr al-Deen al-Sadr in Qum, and Sayyed Muhsin al-Ameen in Lebanon, and they all issued verdicts about the purity of Ahlul-Kitab but it was done secretly to those whom they trusted, and they did not declare it publicly out of fear from the trouble makers, and many of the Jurists view their purity but will not declare it out of fear from the people of ignorance, and Allah deserves to be feared more.]

Mughniyyah also says in “al-Jawami` wal-Fawariq bayn al-Sunnah wal-Shia” pg184:

ما يفعله بعض عوام الشيعة في لبنان والعراق وايران من لبس الأكفان وضرب الرؤوس والجباه بالسيوف في اليوم العاشر من محرم عادة مشينة بدعة في الدين والمذهب وقد احدثها لأنفسهم أهل الجهالة دون ان يأذن بها إمام أو عالم كبير كما هو الشأن في كل دين ومذهب، ولم يجرأ على مجابهتها احد في أيامنا إلا قليل من العلماء وفي طليعتهم المرحوم السيد محسن الأمين العاملي

[What some Shia laymen do in Lebanon and Iraq and Iran, from wearing shrouds and hitting their heads and foreheads with swords on the tenth of Muharram, this is a shameful habit and an innovation in the religion and the Madhab, the people of ignorance innovated it for themselves without permission from an Imam or a big scholar just like what happens in every religion or Madhab, none dared to confront this in our days except very few scholars and at their forefront is Sayyed Muhsin al-Ameen al-`Amili (ra)]
And all of us know how Muhsin al-Ameen was attacked and cursed and refuted by other Shia scholars before the laymen when he opposed Tatbeer and Zinjeer…

al-Tijani talks about smoking in “Kull al-Huloul `inda Aal al-Rassul” pg169:

وإنني استغرب من المراجع عند الشيعة الذين يحرمون اللعب بالشطرنج ولا يحرمون التدخين وشتان بين ضرر كل منهما، وإنني كثيرا ما كنت ناقما على هذا الوضع وكثيرا ما أثرت هذه المسائل مع بعض العلماء فلم اجد من عنده الجرأة الكافية لمنعه وتحريمه، وأذكر ان الشهيد الصدر لم يكن يدخن ابدا وقد سألته عن التدخين فقال: انا لا ادخن وانصح كل مسلم ان لا يدخن ولكني لم اسمع منه التحريم صراحةً، ويقال ان بعض المراجع حرمه على المبتدئين وكرهه للمدخنين وبعضهم يحرمه ولكن لا يجروء على التصريح بذلك خوفا ان يتهم بأنه يعمل بالقياس، وعلى المراجع ان يقولوا فيه قولا صريحا ولا يخشون في الله لومة لائم وعليهم ان يحرموه ولو اجتهادا منهم، اما ان يسكت العلماء والمراجع لأن الناس لا يقبلون ذلك فهذه مشكلة، أو انهم يخافون من ردة فعل المدخنين فلا يقولون بكر اهته وقد سمعت بعضهم يجهد لإقناعي بأن فيه فوائد كثيرة وهذا أمر خطير له أبعاده وقد شجع شبان المسلمين الذين يعرفونه على مداومة التدخين

[I find it strange that the Maraji` of the Shia would forbid playing chess but do not forbid smoking although there is a huge difference between the harm of smoking and the harm of chess. I always hated this situation so I raised these issues many times with some scholars but never found one with sufficient courage to ban it and forbid it. I remember that al-Shaheed al-Sadr never smoked and when I asked him he replied: “I do not smoke and I advise each Muslim not to smoke.” but I never heard him explicitly forbid it. It is said that some scholars forbade it for new smokers but declared it Makruh on the average smoker, and some forbid it completely but they do not have the courage to declare it out of fear of being accused of using Qiyas. The Maraji` have to declare it explicitly and not fear anyone other than Allah, and they need to forbid it even if by their own Ijtihad, but if the scholars and Maraji` remain silent because the people will not accept it then this is a problem, or maybe they fear the reaction of the smokers so they will not declare it as Makruh and I have heard some scholars try their hardest to convince me that in it(smoking) are great benefits(for health) and this is a dangerous matter with many consequences, it has encouraged Muslim youth to smoke regularly.]

And so the caravan of Taqqiyah continues and I congratulate the Shia on their scholars and religion.
